Action in the Itasca County District Court wherein plaintiff sought to recover for labor and materials furnished at the request of defendant C.W. Moore Company, the general contractor, on nursing homes owned by defendant Itasca County. Recovery was also sought against defendant United Pacific Insurance Company on the basis of a performance bond which it furnished. After findings for plaintiff and for defendant county, John A. Spellacy, Judge, defendants Moore and United Pacific appealed from the judgment entered. C.W. Moore Company was the general contractor and Nelson Roofing & Contracting, Inc., was a subcontractor in the construction of public nursing home additions in Itasca County. As required by Minn. St. 574.26, Moore purchased a labor and materials payment bond from United Pacific Insurance Company. Minn. St. 574.31 provides in pertinent part:
